Pursuant to the Nebraska Pure Food Act, (Act) Neb. Rev. Stat. §§81-2,239 to 81-2,292, the Department of Agriculture is responsible for the administration and enforcement of the Act. Section 81-2,279 of the Act, adopted by LB 562 of 2023, provides that as of September 2, 2023, the Department shall establish and maintain a mobile food establishment ordinance registry on the Department's website. The purpose of the registry is to record in a central location the municipal ordinances used to regulate mobile food establishments.
Each city of the first or second shall participate in the registry by providing to the Department the following information:
- The name and address of each person responsible for regulating mobile food establishment operations;
- A sample copy of any form that is required to be submitted in order for the mobile food establishment to operate in the city; and
- A complete electronic record of the ordinances used to regulate mobile food establishments.
If your city does not regulate the operation of mobile food establishments in any way, §81-2,279 provides that you must submit to the Department a written statement confirming that your city does not regulate the operation of mobile food establishments.
Please be aware that §81-2,279 further provides that at the end of 2023, and each December 31st thereafter, your city is required to notify the Department of any new or modified ordinance adopted within such calendar year regulating mobile food establishments.
